These Terms and Conditions (the “Terms”) govern your use of the website ucitystorage.com (the “Website”), which is operated on behalf of U-City Storage (Moscow, Idaho) and Pullman Mini Storage (Pullman, Washington) (together, “we,” “us,” or “our”). By accessing the Website, submitting a form, contacting us, opting in to receive text messages or emails from us, or renting a storage unit through us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Website or our services.

2. Our Services

We operate self-storage facilities in Moscow, Idaho and Pullman, Washington and provide an informational Website where you can learn about our services, review unit availability, contact us, and initiate a rental. Your rental of any specific storage unit is subject to a separate written rental agreement (the “Rental Agreement”) signed at the time of rental. In the event of a conflict between these Terms and your Rental Agreement, the Rental Agreement controls with respect to the rented unit.

3. Eligibility and Account Information

You must be at least 18 years old and able to enter into a binding contract to use our Website and rent a unit. You agree to provide accurate, current, and complete information when you contact us, sign up, or rent a unit, and to keep that information up to date. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.

4. Payments and Billing

When you rent a unit or authorize recurring payments, you authorize us (and our designated payment processor) to charge the payment method you provide for monthly rent, fees, and other amounts due under your Rental Agreement. You are responsible for keeping your payment information current and for any bank, card, or overdraft fees that result from a declined or returned payment. Late payments may result in late fees, lien proceedings, and other remedies described in your Rental Agreement and in applicable state self-storage law.

5. SMS / Text Messaging Program

We offer SMS text messaging so we can reach you about your account, your rental, and optional updates. By providing your mobile number and opting in (for example, by checking a consent box, submitting a form, signing your Rental Agreement, or replying with a keyword such as JOIN or START), you agree to the following:

• Program description: Messages may include rental and billing reminders, payment receipts, gate-access information, account and service notifications, replies to your inquiries, and occasional promotional messages if you have opted in to those separately.

• Message frequency varies based on your account activity and the messages you request.

• Message and data rates may apply. You are responsible for any charges from your mobile carrier.

• Opt out at any time by replying STOP to any message from us. After you reply STOP, we will send one confirmation message and will not send further non-essential SMS messages.

• Reply HELP to any message for help, or contact us at [email protected] or (208) 273-5333.

• Supported carriers may change without notice. Carriers are not liable for delayed or undelivered messages.

You agree not to:

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. STORAGE-UNIT-SPECIFIC OBLIGATIONS ARE GOVERNED BY YOUR RENTAL AGREEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL U-CITY STORAGE, PULLMAN MINI STORAGE, OR OUR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY RELATING TO YOUR STORAGE UNIT IS GOVERNED BY YOUR RENTAL AGREEMENT AND APPLICABLE LAW.

11. Indemnification

You agree to indemnify and hold harmless U-City Storage, Pullman Mini Storage, and our owners, officers, employees, agents, and contractors from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Website, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Governing Law and Venue

These Terms are governed by and construed under the laws of the State of Idaho, without regard to conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in Latah County, Idaho, and you consent to the personal jurisdiction of those courts. Disputes relating to a specific Rental Agreement are governed by that agreement, including its governing-law and venue provisions.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date. Your continued use of the Website after changes are posted means you accept the updated Terms.
